This is the last will and testament of me Robert Strudwick of Wanford Mill in the parish Rudgwick in the county of Sussex Miller first I direct that all my just debts and funeral and testamentary expenses be fully paid and satisfied by my executors hereafter named

I give and bequeath unto my beloved wife Elizabeth so much in such parts of my household furniture plate linen and China and she shall make choice of not exceeding in value the sum of £40 to and for her own absolute use and disposal to be delivered to her immediately after my decease

I give and devise unto my first wife son John Allbery of Bucks Green in the parish of Rudgwick aforesaid Miller all that and those my freehold messuage or tenements water corn mill barns stables buildings lands and premises with their and every of their appurtenances commonly called or known by the names of Wanford and Westhams field containing by estimation fourteen acres be the same more or less situate lying and being in the parish of Rudgwick aforesaid and now in the occupation of myself and said John Allbery to hold the same unto and to the use of that John Allbery his heirs and assigns forever charge and chargeable nevertheless

And I do hereby subject and charge the same and every part and parcel thereof to and with the payment of one annual sum or yearly rent charge of £40 . which I do hereby give and bequeath to my said wife Elizabeth for and during the term of the natural life to be paid half yearly clear of all deductions whatsoever the first payment to be made six calendar months next after my decease and to be in lieu of dower and xxxxbench and in case of non-payment thereof of any part thereof I hereby invest my said wife with the usual powers of entry and distress for the recovery thereof as landlords have for rent in arrears

But in case of the decease of the said John Allbery in my lifetime I give and devise the same messuage mill lands hereditaments and premises unto and to the use of his son Henry Allbery his heirs and assigns forever subject nevertheless and charged with the payment of the same annual sum or yearly rent charge of £40 to my said wife for life in manner herein before mentioned

And I give and devise and bequeath under the said John Allbery and Charles Holden the younger of Slinfold in the said County of Sussex innkeeper and James Butcher of Limmick? in the parish of Rudgwick aforesaid Yeoman all the rest residue and remainder of my real and personal estate effects whatsoever and where soever and of what nature or kinds of which I shall be possessed or interested in or entitled unto at the time of my decease to hold the same and every part thereof unto and to the use of them the said John Allbery Charles Holden and James Butcher their heirs executors administrators and assigns accordingly to the nature and quality thereof respectively nevertheless upon the trusts and to and for the intents and purposes hereinafter mentioned that is to say

Upon trust that they my said trustees or the survivors or survivor of them and the heirs executors and administrators of such survivor do and shall with all convenient speed after my decease absolutely sell and dispose of all the residue of my said real estate and such parts of the residue of my personal estate as shall in its nature be saleable either by public auction or private contract for the most money that can be reasonably gotten for the same and call and collect and receive all such debts sum or sums of money as shall be owing to me at the time of my decease and shall and do stand possessed of and interested in the money to arise or be gotten in either means aforesaid or otherwise under or by virtue of this my will in trust to put and place out at interest upon government or other good and sufficient security or securities in their own names and in such manner as they shall think proper so much thereof as will be sufficient to provide the annual sum of £25 clear of all deductions and paid the same half yearly unto my brother Henry Strudwick for and during the term of his natural life and put out or place out at interest in like manner such further part thereof as will be sufficient to produce the annual sum of £24 clear of all deductions and pay the same quarterly unto my nephew William Strudwick the son of my late brother George Strudwick being a cripple for and during the term of his natural life

And pay and equally devise all the residue of the aforesaid trust moneys unto amongst all my nephews and nieces (except the said William Strudwick) share and share alike when and as they shall respectively attained the age of 18 years and which I do it by give and bequeath to them respectively accordingly and from immediately after the respective decease of my said brother Henry Strudwick and my said nephew William Strudwick I direct my said trustees or survivor of survivors of them or the executors or assigns of such survivor to pay and equally divide the principal sums to be placed out for securing to them my said brother and nephew thier said annuities unto and amongst all my said nephews to nieces share and share alike when and as they shall respectively attain the age of 18 years and which I do hereby give and bequeath to them respectively accordingly

And I do hereby direct that in case any or either of them my said nephews and neices shall happen to die before his her or their share or shares shall become due and payable leaving issue of his her or their body or bodies lawfully begotten that the share or shares of him her or them so dying shall be paid to and equally divided between his her or their issue share and share alike if more than one and if but one then to such only child when it as they shall respectively attained the age of 18 years

And I direct that the receipt of every person entitled to any share under this my will shall notwithstanding their xxxage be good and sufficient discharges to my trustees for the same

And I do hereby declare that the receipt or receipts of them my said trustees or survivor of survivors of them the heirs executors administrators of such survivor to all every and any purchaser of purchasers of the residue of my said real personal estate for the purchase money thereof or of any part thereof shall be a good and sufficient discharge and good and sufficient discharges for the same in every part thereof and that after obtaining such receipt or receipts such purchaser or purchasers shall not be bound or obliged to the application of the said purchase money orl be answerable or accountable to the loss misappropriation or nonapplication thereof of any part or parts thereof respectively

And my will and my meaning is and I do hereby direct that the appointment of the said John Allbery Charles Holden and James Butcher the executors hereinafter named of this my will shall not release or discharge them from the payment of all or any money which they may respectively ower me at the time of my decease

And lastly I do hereby nominate constitute and appoint the said John Allbery Charles Holden and James Butcher executors and trustees of this my will and I direct that they shall be paid their reasonable expenses and for their time and trouble in executing the same

And I revoke all former and other wills and wills by me at any time heretofore made and declare this to be my last will and testament in witness whereof I the said Robert Strudwick the testator have to this my last will and testament containing three sheets of paper to the first two sheets thereof set my hand and to this last sheet thereof set my hand and fixed my seal this 13th day of October in the year of our lord 1829 Robert Strudwick his mark and seal

Signed sealed published and declared by the said Robert Strudwick as and for his last will and testament in the presence of us who in his presence at his request and the presence of each other have hereunto subscribed our names as witnesses James Napper Junior George Butcher Rudgwick George Elphick

Proved on the 16th of March 1831 by the worshipful William Calvary doctor of laws and surrogate by the oaths of John Allbery and Charles Holden to be executors to whom administration was granted having been first duly sworn to administer James Butcher the other executor one of the residual legatees in trust having renounced the probate execution of the said will
